DMCA Policy

1. Overview

AuctionCalc respects the intellectual property rights of others and expects users of auctioncalc.co to do the same. This policy explains how to submit a copyright infringement notice under the Digital Millennium Copyright Act ("DMCA"), and how we respond to valid notices.

2. Filing a DMCA Takedown Notice

If you believe content on auctioncalc.co infringes your copyright, send a written notice to our Designated Agent (below) that includes, at minimum, the following information as required by 17 U.S.C. § 512(c)(3):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it (e.g. a URL);
4. Your contact information, including address, telephone number, and email address;
5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

3. What Happens After We Receive a Notice

Upon receiving a complete and valid notice, we will review it and, where appropriate, remove or disable access to the identified material and notify the user who posted or submitted it. We may also terminate, in appropriate circumstances, the access of users determined to be repeat infringers.

4. Counter-Notification

If you believe material you submitted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent that includes:

1. Your physical or electronic signature;
2. Identification of the material removed and its location before removal;
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the US, an appropriate jurisdiction), and that you will accept service of process from the person who filed the original notice.

Upon receiving a valid counter-notification, we may restore the removed material within 10–14 business days unless the original complainant informs us that they have filed a court action seeking a restraining order.

5. Repeat Infringer Policy

We take repeat infringement seriously. Accounts or users determined, in appropriate circumstances, to be repeat infringers may have their access to the Service terminated.

6. False Claims Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees. Please make sure your claim is accurate before submitting a notice.
